Automatic Legal Aid: Advice and Assistance

Criminal Advice and Assistance (sometimes called the Green Form scheme) is available to anyone detained or arrested by the police in Scotland, regardless of their financial means. It provides immediate access to a solicitor at the police station and covers the initial stages of a criminal matter. You do not need to apply or pass a means test to access this form of legal aid at the police station — it is automatic.

Legal Aid for Court Proceedings

For representation in court, criminal legal aid is available subject to two tests: a financial eligibility test and an interests of justice test. The financial test assesses your income, capital, and any dependants. The interests of justice test considers whether it is in the public interest for you to have representation — generally met where you face a custodial sentence, complex legal issues, or significant consequences including loss of employment or livelihood. Most clients facing criminal charges will pass both tests.

What Legal Aid Covers

Criminal legal aid covers the cost of your solicitor's professional fees and outlays (such as expert witnesses and precognitions) for criminal proceedings in the Sheriff Court and the High Court of Justiciary. It does not cover civil matters, employment tribunal proceedings, or personal injury claims. The Scottish Legal Aid Board sets the rates at which solicitors are paid for legally-aided work.
